As situation that happens quite often throughout the United States is, are illegal immigrants allowed to file a personal injury claim if they’ve been injured in an accident?
Illegal immigration to the United States can happen several ways
- Illegally cross the border or pay someone to illegally smuggle them into the country
- One would also be considered an illegal immigrant if they stayed beyond their visa expiration dates
- Sometimes people enter the United States on a fiancée visa with the intention of getting married, however there are times with the partner changes their mind during the last minute, this can also result in the person becoming an illegal immigrant
- Immigrants who enter the United States on a work visa and stay beyond their work visa expiration dates
There are more people who have over stayed their intended visas and become illegal immigrants then people realize, because this can happen for a number of reasons.
Although Atlanta is not one of the Border States that receive a high amount of illegal immigrants, Atlanta is a popular destination for many illegal immigrants because of its diverse culture, and still receives their fair share of illegal immigrants. Attorney Bob Peters an Atlanta Injury Lawyer, states that despite a person’s immigration status they do not forfeit their right to compensation just because they’re illegally in the United States. Illegal immigrants play a role in the United States economy and have become necessary in some states; because they accept laborious jobs that many Americans will not work at. Because illegal immigrants are a part of the American fabric, they’re also entitled to file injury claims, if they were hurt through no fault of their own.
If an illegal immigrant is injured through no fault of their own either in a motor vehicle accident, a work place accident, a slip and fall or any other accidental means through no fault of their own, the United States does not discriminate their right to file a claim and the opposing attorney should not threaten deportation in order to lower the compensation amounts, this is considered morally unacceptable by the peers in the legal system.
If someone is injured on American soil it should not play a role on whether they receive compensation or not, everyone who’s injured through no fault of their own rightfully deserves compensation for the lost wages, medical expenses, pain and suffering they experience as a result of the injuries sustained.
